Terms & Conditions
Effective Date: December 2024
By placing an order with Golden Sol Florista, the Client agrees to the following Terms & Conditions. These policies ensure transparency and protect both the Client and Golden Sol Florista’s brand and artistic integrity.
1. Fresh & Dried Flower Availability: Fresh and dried flowers are seasonal, and fillers and flowers are subject to change based on availability. If any flowers become unavailable due to shipment delays, seasonality, supply obstacles, or do not meet quality standards, Golden Sol Florista reserves the right to substitute them with a suitable alternative of similar quality without prior notice.
2. Arrangement Variability: Arrangements may not be identical to reference photos, which serve as visual guides only. Each piece is handmade with care, and substitutions may be made when necessary. We strive to create arrangements as close to the reference as possible.
3. Delivery Responsibilities: The sender is responsible for providing accurate and complete delivery information. It is the sender’s responsibility to ensure someone is available to receive the order. Flowers are perishable, and accurate details help avoid delivery issues.
4. Natural Variations: Some flowers may have natural discoloration on their petals. These are considered fresh and are not deemed defective.
5. Refunds & Complaints: Due to the perishable nature of flowers, refund requests, complaints, and delivery date changes will be reviewed on a case-by-case basis at our discretion.
6. Refunds & Cancellations: Orders without visible defects do not qualify for refunds due to a client’s change of mind.
7. Change of Delivery Date: Requests for delivery date changes must be made at least three (3) days before the original date and are subject to approval.
8. Changes to Orders: Once an order is submitted, changes to the arrangement are highly discouraged.
9. Order Confirmation & Payment: An order is only confirmed once full payment has been received and proof of payment has been sent to goldensolnyc@gmail.com.
10. Delivery Fees & Responsibilities: The delivery fee is the responsibility of the customer. Customers may book their own courier at their own expense. However, if a third-party courier is chosen, Golden Sol Florista is not responsible for the arrangement once it has been handed over. A photo of the completed arrangement can be provided upon request.
11. Wrap & Ribbon Customization: Wrapper and ribbon colors may be changed upon request, subject to availability. Otherwise, the florist will determine the final selection.
12. Delivery Timing: While we do our best to meet delivery and pick-up time slots, exact timing cannot be guaranteed due to potential unforeseen road conditions.
13. Redelivery Policy: If the recipient is unavailable at the stated address, a re-delivery fee may apply, along with an additional charge (up to 50% of the arrangement price) depending on the condition of the flowers.
14. Force Majeure: Golden Sol Florista is not liable for delays caused by factors beyond our control, including but not limited to traffic, accidents, natural disasters, personal emergencies, and global events such as COVID-19.
15. Price Adjustments: Prices may change without prior notice due to fluctuating supplier costs.
16. Exclusivity Clause: Golden Sol Florista retains exclusive rights as the sole florist for any event where our services have been contracted. The Client agrees that no other florist, floral designer, or flower service provider will contribute floral arrangements for the event unless otherwise agreed in writing by Golden Sol Florista. This ensures consistency in design, branding, and execution. Any violation of this clause may result in service cancellation without refund.
17. Photography & Permitted Uses: The Client agrees that Golden Sol Florista (“Provider”) may photograph and/or use images of floral designs and event setups for portfolio, advertising, social media, website, blog, magazine submissions, and other promotional purposes. This includes, but is not limited to, showcasing Golden Sol Florista’s work across digital and print platforms.
The Client waives the right to inspect or approve the final images or content in which their event and/or floral arrangements appear. The Client also acknowledges that no compensation shall be provided for the use of such images.
If the Client wishes to restrict photography and promotional use, they must submit a written request prior to the event, and additional fees may apply.
Additionally, any third-party photography that includes Golden Sol Florista’s floral designs must credit Golden Sol Florista when shared publicly (e.g., social media, websites, publications).
18. Agreement to Terms: By placing an order with Golden Sol Florista, the Client acknowledges and agrees to all terms outlined in this document. These policies ensure a seamless and professional experience for both parties.
